  • Minors may participate only with parent/guardian or school/clinic authorization when required.

  • Where applicable, volunteers may be subject to screening, verification, or background checks consistent with law.

4) Our Services

We provide: (a) education and community programs; (b) donation logistics for panty liner ovulation tests; (c) chapter toolkits and partner support; (d) optional research/pilots under separate consent; and (e) communications and impact reporting.

We may modify, suspend, or discontinue any service at any time. We do not guarantee continuous availability.

5) Health & Safety Disclaimers (Very Important)

  • Not Medical Advice. Our content and donated products are educational and for general wellness awareness only. They do not replace professional medical advice, diagnosis, or treatment.

  • Emergency: If you think you may have a medical emergency, call your local emergency number immediately.

  • Panty Liner Ovulation Tests: These are cycle-awareness tools. They are not contraception, not a pregnancy test, and not a substitute for professional fertility care. Do not rely on them as your sole method to prevent or achieve pregnancy.

  • Regulatory Status: Unless expressly stated on product labeling, our donated products are not FDA-cleared/approved medical devices and are provided as-is for educational use. Follow all instructions, warnings, and expiry dates on the packaging. Discontinue use if irritation occurs and consult a clinician if you have concerns.

  • No Guarantee of Outcomes. Individual results vary; we do not warrant any health, fertility, or timing outcome.

6) Accounts & Communications

You are responsible for safeguarding your account credentials and for all activity under your account. You consent to receive communications (program updates, logistics, legal notices). You can manage non-essential email preferences at any time.

7) Acceptable Use

You agree not to:

  • misuse, disrupt, or interfere with our services or security;

  • submit inaccurate information or impersonate others;

  • harvest data or scrape without written permission;

  • upload malware or infringing, defamatory, or unlawful content;

  • use donations for resale or any commercial purpose;

  • violate applicable laws, sanctions, or export controls.

We may suspend or terminate access for violations.

8) Donations, Shipments & Fulfillment

  • Eligibility & Quantity. Donation eligibility, quantities, and timing are subject to inventory, logistics, safety, and local law. We may verify eligibility and decline or delay shipments at our discretion.

  • No Resale/Transfer for Value. Donated items must not be resold or exchanged for value.

  • Shipping Risk. Title and risk of loss pass upon delivery to the carrier. We are not responsible for delays outside our control.

  • Recalls & Safety. We may request the return or disposal of products for safety reasons. You agree to cooperate with recalls or notifications.

  • Refunds. Monetary donations are generally non-refundable. If you made an error, contact [donations@yourdomain.org] within 15 days and we’ll review case-by-case. We do not provide tax or legal advice—consult your advisor.

9) Partners, Chapters & Events

  • Chapters operate under our brand guidelines and code of conduct. Use of our name/logo requires written permission and compliance with our policies.

  • Training & Safety. Volunteers must follow training, local health/safety rules, and safeguarding practices when engaging with youth or vulnerable groups.

  • Events. Participation is voluntary and at your own risk. We may require waivers, photo releases, or venue rules.

10) Research & Pilots

If you participate in research or product pilots, you will receive a separate consent describing data collected, risks/benefits, and contacts. That consent governs in the event of any conflict with these Terms on research matters.

11) User Content & Testimonials

By submitting stories, testimonials, images, or other content (“User Content”), you grant Hormolize a worldwide, royalty-free, sublicensable license to use, reproduce, modify (for length/clarity), publish, and display the User Content in any media for program, educational, and fundraising purposes. You represent that you have rights to the content and that it does not infringe others’ rights. You may withdraw permission for future uses by contacting [privacy@yourdomain.org]; we will remove prospectively where feasible.

12) Intellectual Property

All site content, toolkits, logos, and materials are owned by Hormolize or its licensors and protected by law. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works without written permission. Limited, revocable, non-transferable permission is granted to access and use the site for its intended, lawful purposes.

13) Third-Party Services & Links

We use third-party providers (e.g., payment processors, analytics, shipping) and may link to external sites. Their terms and privacy policies apply to their services. We are not responsible for third-party content or practices.

14) Privacy

Our Privacy Policy explains how we collect, use, share, and safeguard personal information. By using our services, you consent to such processing consistent with that policy.

15) Warranties & Disclaimers

SERVICES, CONTENT, AND DONATED PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HORMOLIZE OR ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE AT ISSUE IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permissible.

17) Indemnification

You agree to defend, indemnify, and hold harmless Hormolize and its personnel from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the services or products; (b) your User Content; (c) your violation of these Terms or law; or (d) your misuse or resale of donations.

18) Arbitration; Class Action Waiver (Optional—consult counsel)

Arbitration. Any dispute arising out of or relating to these Terms or the services will be resolved by binding arbitration administered by [JAMS/AAA] under its rules, rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction for IP or data-security misuse.
Class Waiver. Disputes must be brought in an individual capacity; class actions and class arbitrations are not permitted.
Opt-Out. You may opt out within 30 days of first agreeing by emailing [legal@yourdomain.org] with subject “Arbitration Opt-Out.”

(If your organization works heavily with government entities, schools, or specific countries, ask counsel whether arbitration/class waivers are advisable.)

19) International Users; Export & Sanctions Compliance

You must comply with all applicable export control and sanctions laws. You may not use or access our services if you are located in, or are a national of, a country or region embargoed by the U.S. or other applicable authorities, or if you are on a restricted party list.

20) Governing Law & Venue

These Terms are governed by the laws of [State/Province/Country], excluding its conflict-of-law rules. Subject to Section 18 (Arbitration), the exclusive venue for any permitted court action is the state and federal courts located in [County, State], and you consent to their jurisdiction.

21) Changes to Terms

We may update these Terms from time to time. Material changes will be posted with a new “Last updated” date. Your continued use following changes means you accept the revised Terms.

22) Term & Termination

These Terms remain in effect while you use our services. We may suspend or terminate access at any time for any reason. Upon termination, Sections intended to survive (e.g., IP, disclaimers, limitation of liability, indemnity, governing law) will continue.

23) Miscellaneous

  • Severability. If any provision is unenforceable, the remainder remains in effect.

  • No Waiver. Our failure to enforce a provision is not a waiver.

  • Assignment. You may not assign these Terms without our consent; we may assign under law or in connection with reorganization/merger.

  • Entire Agreement. These Terms, plus any applicable program-specific terms and the Privacy Policy, constitute the entire agreement between you and us regarding the services.

  • Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control (e.g., disasters, strikes, wars, pandemics, supply-chain issues).
